IndyPlanet’s Virtual Gift Cards are brought to you by 01 Comics, Inc., which does business as IndyPlanet, and which shall hereafter be referred to here as “IndyPlanet,” or by words such as “us,” “we,” or “our.” “Redemption” of Virtual Gift Cards refers to the addition of Virtual Gift Card amounts to the recipient’s customer account balance. “Use” of the Virtual Gift Cards refers to use of the recipient’s account balance to purchase an eligible items.

IndyPlanet Virtual Gift Cards allows you to purchase and send store credit at IndyPlanet by email. By purchasing, redeeming, or using IndyPlanet Virtual Gift Cards, you are agreeing to the following terms and conditions:

1. Purchase, Redemption and Use.

Purchases of IndyPlanet Virtual Gift Cards are final and not refundable. You will be charged at the time you purchase aIndyPlanet Virtual Gift Card. You may purchase, redeem, and use IndyPlanet Virtual Gift Cards only at our website, www.ip.dream.press (the “Website”), and to do so you must have an IndyPlanet account (“User Account”). Recipients will be notified of IndyPlanet Virtual Gift Cards by email. To redeem an IndyPlanet Virtual Gift Card, the recipient will add the IndyPlanet Virtual Gift Cards amount to an existing or newly created User Account. Instructions for creating a User Account and redeeming Virtual Gift Cards will be available through the notification email and on our Website.

When you redeem an IndyPlanet Virtual Gift Card, the amount of the Virtual Gift Card is added to your User Account balance. Purchases are automatically charged against your account balance before being charged to your payment method. Purchase amounts exceeding your available account balance will be charged to your payment method.

2. Expiration, Fees, and Eligible Items.

After you redeem your IndyPlanet Virtual Gift Cards, your account balance can be used towards the purchase any item or items at our website.

IndyPlanet Virtual Gift Cards are not subject to fees or expiration dates, unless offered in connection with special promotions and specifically specified at the time of purchase.

3. Limitations.

IndyPlanet Virtual Gift Cards may not be used to purchase additional Virtual Gift Cards or for purchases made prior to the purchase of the IndyPlanet Virtual Gift Card. You may not redeem or use IndyPlanet Virtual Gift Cards on foreign (country top level domain) websites, on any mobile applications, on any application, site, or service other than ip.dream.press or for any purchase not in U.S. dollars. IndyPlanet Virtual Gift Cards may not be redeemed for cash. You may not transfer or assign IndyPlanet Virtual Gift Cards or account balances to any other person or account. IndyPlanet Virtual Gift Cards may not be purchased, redeemed, or used in any countries where Paypal does not do business.

4. Terms and Privacy.

We may at our discretion disclose to the purchaser of an IndyPlanet Virtual Gift Cards whether or not the recipient has redeemed the Virtual Gift Card. Aside from that one exception, IndyPlanet’s standard terms and privacy policies apply to the purchase of IndyPlanet Virtual Gift Cards

5. Risk, Exclusion of Warranties, and Limitation of Liability.

Risk of loss of IndyPlanet Virtual Gift Cards passes to the purchaser upon our electronic transmission of notice of the Virtual Gift Card to the recipient email address specified by the purchaser. We are not responsible if an IndyPlanet Virtual Gift Card is lost, stolen, used without authorization, or if a recipient fails to redeem or use a Virtual Gift Card.

IndyPlanet Virtual Gift Cards are provided without warranty of any kind. If an IndyPlanet Virtual Gift Card fails to function, or if any other claim relating to a Virtual Gift card is asserted, your sole remedy and our sole liability will be refund or replacement of the last balance held on such Virtual Gift Card. We will have no liability for any incidental, indirect or consequential damages arising out of or relating to Virtual Gift cards or these terms, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, even if we or our authorized representatives have been advised of the possibility of or could foresee such damages. In no event will IndyPlanet have any liability for unauthorized access to, or alteration, theft or destruction of IndyPlanet Virtual Gift Card. The laws of certain states or other jurisdictions may not allow the exclusion of certain implied warranties or exclusion or limitations of liability, and, accordingly, some of the above exclusions and limitations may not apply to you, and you may have rights in addition to those contained in thse terms. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

6. Governing Law.

All matters relating to IndyPlanet Virtual Gift Cards or these Terms will be governed by the internal laws of the State of Florida, without regard to any provision of Florida law that would result in the application of the law of any other State, country or jurisdiction, and without reference to the U.N. Convention on Contracts for the International Sale of Goods.

7. Changes to these Terms.

We reserve the right to change these Terms at any time, without prior notice to you, by posting the new Terms on our Website, or providing notice through any other means we choose in our discretion. To the extent permitted by applicable law, any change will become effective at the time we post the revised Terms on our Website or otherwise provide notice. Unless we state otherwise, changes will apply to your existing and future IndyPlanet Virtual Gift Cards and account balances. By purchasing, redeeming, or using any IndyPlanet Virtual Gift Cards after changes are posted on our Website or otherwise made available to you, you are agreeing to such Terms as changed.

8. Almost Done …

We reserve the right to correct any clerical, accounting, or billing error and to adjust the balance of your account accordingly. If you have any questions regarding your account balance, please contact us.

If any of these provisions, terms, provisions of terms, etc. is determined to be illegal or unenforceable, that provision or term will be eliminated or limited to the minimum extent necessary to keep all other provisions and terms in full force and effect. Captions, boldface, and italics are included here for clarity’s sake and the convenience of the reader, and will not affect the interpretation of these Terms.
